Earthbound Holding LLC Seeks Dismissal of Employee Data Breach Lawsuit in Texas Federal Court On October 13, 2026, Earthbound Holding LLC, a retail company, filed a motion in the U.S. District Court for the Northern District of Texas to dismiss a proposed class action lawsuit. The suit, brought by employees, alleges the company failed to protect sensitive worker data, allowing cybercriminals to access it. Earthbound Holding argued that the plaintiffs did not sufficiently demonstrate they suffered concrete harm from the breach, a key requirement for legal standing. The case centers on whether the exposure of personal data alone constitutes an injury under the law. The outcome of the motion could set a precedent for how courts handle data breach litigation, particularly in cases where plaintiffs allege risk of future harm rather than immediate financial or identity-related damages. The court has not yet ruled on the request.
